These Terms & Conditions (“Terms”) govern your use of the Electric Sky Visuals website and your communications and interactions with Electric Sky Visuals (“Electric Sky Visuals,” “we,” “us,” or “our”).

Specific client projects may also be governed by a separate proposal, statement of work, production agreement, or contract. Where a signed agreement conflicts with these website Terms, the signed agreement controls for that project.

• Related creative and production services

Services, deliverables, schedules, pricing, usage rights, revisions, and payment terms will generally be defined in a separate written proposal or agreement.

2. Website Information

Information on this website is provided for general informational and marketing purposes. We may update, remove, or change website content, services, packages, pricing, and availability without notice.

Submitting a form does not create a client relationship or obligate Electric Sky Visuals to accept a project.

3. Inquiries and Eligibility

You agree that information you submit is accurate and that you have authority to provide it. We may decline an inquiry or project at our discretion, including when:

• The project is outside our services or availability
• The requested work conflicts with existing commitments
• The information provided is incomplete or inaccurate

4. Proposals and Project Agreements

A project begins only after any required agreement has been signed and any required deposit or initial payment has been received.

• Production dates are not reserved until required paperwork and payment are completed
• Client delays may affect delivery dates
• Travel, permits, locations, talent, rentals, licensing, and third-party costs may be charged separately

5. Payments

Payment terms will be stated in the applicable proposal, invoice, or agreement.

Unless otherwise agreed:

• Payments are due by the stated deadline
• Deposits may be non-refundable once production resources have been reserved
• Late payments may delay production or delivery
• Additional work outside the agreed scope may be billed separately
• Final deliverables may be withheld until outstanding balances are paid

6. Cancellations and Rescheduling

Cancellation and rescheduling terms will be governed by the applicable project agreement.

Production work often requires reserving dates, personnel, equipment, locations, and other resources. Fees may apply when a client cancels or reschedules after resources have been committed.

7. Client Responsibilities

Clients are responsible for providing timely access to:

• Accurate project information
• Brand assets
• Scripts, talking points, or approvals
• Locations and necessary permissions
• Participants, speakers, employees, or talent
• Products or materials needed for production
• Feedback and revision instructions
• Any releases, licenses, or authorizations assigned to the client under the project agreement

Client delays may extend the production schedule.

8. Intellectual Property

Ownership and licensing terms for project deliverables will be stated in the applicable agreement.

Unless otherwise agreed in writing:

• Electric Sky Visuals retains ownership of its pre-existing tools, templates, production techniques, workflows, project files, and intellectual property
• Clients receive rights only to the final deliverables described in their agreement
• Raw footage, project files, source files, and unused materials are not included unless expressly stated
• Third-party music, fonts, footage, software, or other licensed materials remain subject to their respective license terms

9. Portfolio and Promotional Use

Unless a written agreement states otherwise, Electric Sky Visuals may request permission to display completed work for portfolio, website, social-media, award, promotional, and sales purposes.

Any portfolio rights involving confidential, embargoed, or sensitive work should be addressed in the project agreement.

10. Revisions

Included revisions, revision deadlines, and additional revision fees will be stated in the project agreement.

Revision requests that alter the approved concept, scope, script, production plan, or deliverables may be treated as additional work.

11. Results and Marketing Disclaimer

Electric Sky Visuals does not guarantee any particular number of:

• Views
• Leads
• Customers
• Speaking engagements
• Sales
• Revenue
• Social-media followers
• Advertising results
• Search rankings
• Business outcomes

Marketing and advertising performance depends on many factors outside our control, including the offer, market, audience, sales process, budget, competition, platform changes, and client execution.

12. Third-Party Services

Our website and services may interact with third-party platforms such as:

• GoHighLevel or LeadConnector
• Email and SMS providers
• Payment processors
